Terms of Service

Please read these Terms of Service carefully before using Khichad logistics services. These terms contain important information about your legal rights, remedies, and obligations. By using our services, you agree to be bound by these terms.

1. Acceptance of Terms

These terms form the entire contract between you and Khichad Logistics Pvt. Ltd. Your shipment is subject to these terms. No employee of Khichad Logistics Pvt. Ltd. or anyone else has any authority to change any of our terms or conditions, or make any promise on our behalf.

2. Shipment Definition

Shipment refers to all documents or parcels that travel under one airway bill. Please verify your airway bill details carefully before dispatch. You are responsible for ensuring that all information provided including addresses, contact numbers, and shipment contents is accurate and complete.

3. International Shipments & Customs

For international shipments, we act as your agent for Customs clearance purposes. You authorize us to act on your behalf for all customs-related matters. Any customs duties, taxes, or fees imposed are your responsibility.

4. Prohibited Items

Items restricted by IATA/ICAO regulations are not accepted for shipping. This includes hazardous materials, illegal substances, weapons, currency, jewellery (booking of currency/jewellery is strictly banned), perishable goods without proper packaging, and items that violate international shipping regulations. Shipping prohibited items may result in account termination and legal action.

5. Inspection & Weight Charges

All shipments may be inspected by us or by customs and regulatory authorities. Charges are based on the higher of actual weight or volumetric weight (calculated as Length × Breadth × Height / 5000 for air shipments). You agree to accept our weight determination as final.

6. Payment Responsibility

If the receiver or any third party designated to pay does not pay the shipping charges, you (the shipper) agree to pay all charges including freight, duties, taxes, and any applicable fees. All payments must be made in accordance with the payment terms provided at the time of service.

7. Claims Process

All claims for loss, damage, or delay must be submitted in writing within 30 days from the date of shipment. Claims submitted after this period will not be entertained. Supporting documentation including proof of value and damage must be provided.

8. Liability Limitations

Our liability for any loss or damage to shipments is limited to Rs. 100/- only for domestic shipments and USD 100 or the actual value of the shipment, whichever is lower, for international shipments. This limitation applies unless additional insurance coverage has been purchased.

9. Actual Value Definition

For claims purposes, the actual value of a shipment means the cost of repair, replacement at current market value, or the fair market value of the item, whichever is lowest. Sentimental value or consequential losses are not considered.

10. GST & Taxes

Goods and Services Tax (GST) is charged as per Government of India notifications. CGST and SGST apply for intra-state shipments, while IGST applies for inter-state shipments. All applicable taxes will be clearly mentioned on your invoice.

11. Delivery Times

Delivery times mentioned are estimates only and are not guaranteed. We are not liable for any delays in delivery. While we make every effort to deliver on time, delays may occur due to factors including weather, traffic, customs clearance, and other circumstances beyond our control.

12. Force Majeure

Khichad Logistics Pvt. Ltd. shall not be liable for any loss, damage, or delay caused by events beyond our reasonable control, including but not limited to natural disasters, war, terrorism, civil unrest, strikes, government actions, pandemic, or any act of God.

13. Consequential Damages

We are not liable for any indirect, incidental, special, or consequential damages arising from the use of our services, including but not limited to loss of profits, business interruption, or loss of business opportunity, regardless of whether we were advised of the possibility of such damages.

14. International Conventions

The Warsaw Convention and subsequent amendments may apply to international air shipments. Our liability is limited as per these conventions. For domestic shipments, liability is limited to INR 100, and for international shipments, liability is limited to USD 100 per shipment.

15. Governing Law & Jurisdiction

These terms shall be governed by and construed in accordance with the laws of India. All disputes arising from these terms or our services shall be subject exclusively to the jurisdiction of courts in Mumbai, Maharashtra, India.
